Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Protorb mobile application ("App," "Service," "we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms and our Privacy Policy.

2. Age Requirements

You must be at least 13 years old to use Protorb. If you are under 18, you represent that you have your parent or guardian's permission to use the App. We reserve the right to request proof of age.

2a. Zero-Tolerance Policy for Objectionable Content and Abusive Users

The following content and behaviors are strictly prohibited and will not be tolerated under any circumstances:

• Hate speech, discriminatory language, or content targeting individuals based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
• Harassment, threats, intimidation, or bullying of any user
• Sexually explicit, pornographic, or adult content of any kind
• Content that exploits or endangers minors in any way
• Violent, graphic, or disturbing content
• Content that promotes self-harm, suicide, or dangerous activities
• Spam, scams, phishing, or deceptive content

Enforcement: We review all reported content and act within 24 hours of receiving a report. Confirmed violations result in immediate removal of the offending content and permanent ejection of the responsible user. We do not reinstate accounts terminated for policy violations.

Identifiable accounts required: All users must maintain an identifiable profile with a display name and unique username. Anonymous posting is not permitted. Your username is permanent and cannot be changed after account setup.

3. Account Registration

3.1 Account Creation

• You must provide accurate, current, and complete information
• You are responsible for maintaining the security of your account
• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized access

3.2 Account Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• You submit inappropriate content
• Your account remains inactive for an extended period

4. Use of Service

4.1 Permitted Use

You may use Protorb to:

• Discover and explore fun websites
• Like or dislike website recommendations
• Submit website suggestions for review
• Interact with app features as intended

4.2 Prohibited Activities

You agree NOT to:

• Submit malicious, harmful, or inappropriate websites
• Upload spam, malware, viruses, or harmful code
• Impersonate others or misrepresent your affiliation
• Harass, abuse, or harm other users
• Reverse engineer, decompile, or disassemble the App
• Use automated systems (bots, scrapers) without permission
• Attempt to gain unauthorized access to systems
• Submit copyrighted or trademarked content without permission
• Manipulate or game the recommendation system
• Collect or harvest user data
• Use the App for commercial purposes without authorization

5. Website Submissions

5.1 Submission Guidelines

When submitting websites, you agree that:

• Websites must be appropriate for a teen (13+) audience
• Submissions must not contain adult content, violence, hate speech, or illegal material
• You have the right to share the website URL
• Descriptions must be accurate and not misleading
• You will not submit duplicate or spam entries

5.2 Review Process

• All submissions are reviewed before approval
• We reserve the right to reject any submission
• No guarantee of approval or publication timeline
• We may edit descriptions for clarity or appropriateness

5.3 License Grant

By submitting content, you grant Protorb a worldwide, non-exclusive, royalty-free license to use, display, and distribute your submissions within the App.

6. Content and Intellectual Property

6.1 Our Content

The App, including its design, features, text, graphics, logos, and code, is owned by Protorb and protected by copyright, trademark, and other intellectual property laws.

6.2 Third-Party Websites

Protorb provides links to third-party websites. We do not control or endorse these websites and are not responsible for their content, privacy policies, or practices.

6.3 User Content

You retain ownership of content you submit, but grant us the rights described in Section 5.3.

7. Disclaimers and Limitations of Liability

7.1 Service "As Is"

Protorb is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7.2 Website Content Disclaimer

We do not control third-party websites featured in the App. We are not responsible for:

• Accuracy, safety, or appropriateness of external content
• Changes to external websites after approval
• Technical issues with linked websites
• Privacy practices of external sites

7.3 Limitation of Liability

To the maximum extent permitted by law, Protorb shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or errors
• Unauthorized access to your data
• Content or conduct of third parties

Our total liability shall not exceed $100 USD or the amount you paid to use the App (currently $0).

8. Indemnification

You agree to indemnify and hold harmless Protorb from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of others
• Content you submit

9. Privacy & Data Collection

Your privacy is important to us. By using Protorb, you acknowledge and agree that we collect and use your data as described in our Privacy Policy.

9.1 Required Data Collection

To use the App, you must consent to our collection of:

• Personal information (name, email, user IDs)
• App activity (interactions, search history, content)
• Device information (device IDs, performance data)
• Messages and user-generated content

9.2 Data Usage

We use collected data for app functionality, analytics, personalization, communications, security, and account management. For full details, see our Privacy Policy.

9.3 Account Deletion

You may delete your account at any time through app settings or by visiting protorb.com/account-deletion. Upon deletion, your data will be permanently removed within 30 days.

10. Modifications to Service

We reserve the right to:

• Modify or discontinue the App at any time
• Change features, functionality, or content
• Impose limits on certain features
• Remove content that violates these Terms

We will attempt to notify users of significant changes but are not obligated to do so.

11. Changes to Terms

We may update these Terms periodically. Changes will be effective when posted with an updated "Last Updated" date. Continued use of the App after changes constitutes acceptance of the new Terms.

12. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access immediately, without notice, for any violation of these Terms.

13. Dispute Resolution

13.1 Informal Resolution

Before filing a claim, you agree to contact us and attempt to resolve disputes informally.

13.2 Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

13.3 Arbitration

Any disputes shall be resolved through binding arbitration rather than in court, except you may assert claims in small claims court if they qualify.

14. General Provisions

14.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Protorb.

14.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

14.3 No Waiver

Failure to enforce any provision does not waive our right to enforce it later.

14.4 Assignment

You may not assign these Terms. We may assign our rights without restriction.

15. App Store Terms

If you downloaded Protorb from the Google Play Store or Apple App Store, you agree to comply with their respective terms of service.
